In a decision that creates broad immunity for Saudi Arabia in terrorism lawsuits, the Supreme Court yesterday let stand lower-court rulings that the desert kingdom and senior members of the Saudi royal family are not liable for the 9/11 attacks. As is typical in such cases, the court offered no explanation for its decision not to hear an appeal of a ruling by the U.S. Court of Appeals for the Second Circuit that the Foreign Sovereign Immunities Act barred terrorism lawsuits against foreign governments unless they had been designated terrorism supporters by the State Department. In the case of Saudi Arabia, there has been no such designation.
