"A review of the evidence, including the autopsy report received on January 19, 2010, witness statements obtained by the Baltimore Police Department, and witness interviews conducted by this office, supports the finding that John Pontolillo reasonably believed he was in danger of imminenet death or serios bodily injury and was justified in striking Donald Rice," State's Attorney Patricia Jessamy said in a statement to the press. Pontolillo used a samurai sword to strike Donald Rice, 49, a repeat offender who had just been released from jail a few days before.
